California Consumer Privacy Act Notice - California Residents Only

This California Consumer Privacy Act Notice (“Notice”)  supplements the information contained in Farm Credit West’s general Privacy Notice and applies solely to all visitors, users, and others who reside in the State of California ("consumers" or "you"). We adopt this Notice to comply with the California Consumer Privacy Act (CCPA) and any terms defined in the CCPA have the same meaning when used in this Notice.  Farm Credit West is referred to in this Notice as “we” or “us”.  This Notice explains how we collect, use, and disclose personal information about California residents.

Under the CCPA, “personal information’ is information that identifies, relates to, describes,  is capable of being associated with, or could reasonably be linked, directly or indirectly with  a particular California resident or household (“Personal Information”).

Categories of Information We Collect

We collect Personal Data in a variety of contexts.  For example, we collect Personal  Information to provide commercial financial products and services, and for our employment and human resources purposes. The Personal Information that we collect about a specific California resident will depend on, for example, our relationship or interaction with that individual.

In the past 12 months, we have collected the following categories of Personal Information:

A name, signature, Social Security number, physical characteristics or description, address ,telephone number, government issued identification number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number or any other financial information, medical information or health insurance information.

We collect some Personal Information within this category.

C. Protected classification characteristics under California or federal law

Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information).

We collect some Personal Information within this category.

D. Commercial information

Records of personal property, products or services purchased, obtained or considered, or other purchasing or consuming histories or tendencies.

E. Biometric information

Genetic, physiological, behavioral, and biological characteristics, fingerprints, faceprints and voiceprints.

We collect some Personal Information within this category.

F. Internet or other similar network activity

Browsing history, search history, information on a consumer’s interaction with a website, application or advertisement.

We collect some Personal Information within this category.

G. Geolocation data

Geolocation data such as device location.

H. Sensory data

Audio, electronic, visual, thermal, olfactory, or similar information.

We collect some Personal Information within this category.

I. Professional or employment-related information

Current or past job history.

J. Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.W. Section 1232g, 34 C.F.R. Part 99))

Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.

We do not collect any Personal Information within this category.

K. Inferences drawn from other personal information

Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Personal Information does not include publicly available information from government records, deidentified or aggregated consumer information, or other information specifically exempted by statute (such as health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and other sector-specific privacy laws (including the Fair Credit Reporting Act, the Gramm-Leach-Bliley Act, the California Financial Information Privacy Act, and the Driver’s Privacy Protection Act of 1994)).

Sources of Personal Information
The sources from which we collect Personal Data depend on, among other things, our relationship or interaction with a specific California resident.  We collect the categories of Personal Information listed above both directly from you when you interact with us, indirectly from you as you interact with our website, and from third parties as further described below:

Anonymous Information Collected and Stored Automatically
Cookies are small pieces of data that are downloaded to your computer or mobile device when you visit a website or application. Our site uses cookies that automatically collect general information anonymously (such as the type of browser you use, the file names you request and the domain name from which you made your request) to improve our website and better meet your needs. When you visit our website, we collect information about your Internet connection, the number of visits to our website, average time spent on our website, what pages have been loaded and when you last visited the website. We use this information to help us make our site more useful to visitors, to learn about the number of visitors to our site and the types of technology our visitors use. We do not use targeted marketing or behavioral tracking technologies.  The information collected does not identify you personally. When you visit our website, we automatically collect and store the following information about you:

Information That You Provide Directly to Us
We do not collect any Personal Information about you when you visit our website unless you give us that information as part of a request for information, you subscribe to an e-mail list, you enroll in Online Banking, you apply for a job, or you register for a myFCW account.  We also collect Personal Information you submit to us when you speak to our representatives over the phone or in person, or when you submit information directly to us (such as paper forms including employment forms and job applications).  We use this type of information to respond to your requests and may enter the information you submit into an electronic database.

  • Information from Third Parties.
    We may receive Personal Information about you from various third parties such as: analytics providers, data aggregators, advertising networks, search information providers, affiliates, operating systems and platforms, and service providers.  We also may Personal Information about you from outside companies or organizations to support human resource and workforce management activities.

    Why We Collect Personal Data and How We Use or Disclose It

  • The purposes for which we collect and use Personal Data depend on, among other things, our relationship or interaction with a specific California resident.  We may use or disclose your Personal Information we collect for one or more of the following business purposes:

  • - To provide and manage products and services and to fulfill or meet the reason you provided the information. For example, if you share your name and contact information to ask a question about our services, we will use that Personal Information to respond to your inquiry. If you provide your Personal Information to purchase services from us, we will use that information to provide those services to you. We will also save your Personal Information to facilitate ongoing processing of the services.
  • - To provide, support, personalize, and develop our website and services.
  • - To create, maintain, customize, and secure your account with us.
  • To process your requests, transactions and payments and prevent transactional fraud.
  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
  • To help maintain the safety, security, and integrity of our website and services, databases, and other technology assets and business.
  • For testing, research, analysis, and product development, including to develop and improve our website and services.
  • To respond to law enforcement requests and as required by applicable law, court order or governmental regulations.
  • As described to you when collecting your Personal Information or as otherwise required by law.
  • To engage in loan participations or other business needs.
  • To support employment and human resource management. Examples: provide benefits to employees and dependents, including healthcare and retirement plans; manage pay and compensation activities; process employment applications; government compliance reporting (for example Affirmative Action plan reporting).

We will not collect additional categories of Personal Data or use the Personal Data we collected for materially different, unrelated, or incompatible purposes without providing notice to you.

We may disclose your Personal Data to a third party for a business purpose, and when we do so, we enter into a contract describing the purpose for the disclosure and require the recipient to keep the Personal Information confidential and not use it for any purpose except for performing under the contract.  We share your Personal Information with the following categories of third parties: Service Providers (such as technology service providers and financial service providers), regulatory bodies,  outside organizations in connection with human resource activities and workforce management and loan participants.

      In the preceding 12 months, we disclosed Personal Information for a business purpose to the following categories of third parties:

    • Service Providers
    • Regulatory bodies
    • Outside organizations in connection with human resource activities and workforce management
    • Loan participant entities

Sales of Personal Information.
Farm Credit West does not sell any categories of Personal Information to any Third Parties (as defined under California Civil Code section 1798.140) and has not sold any Personal Information in the preceding twelve (12) months.  We do not sell the Personal Information of minors under 16 years of age without affirmative authorization.

Consumer Requests: Your Rights and Choices About Personal Information Under California Law
The CCPA provides California residents with specific rights regarding their Personal Information. This section describes your CCPA rights and how to exercise those rights by submitting a consumer request (“Consumer Request”).

Access to Specific Information and Data Portability Rights
You have the right to request that Farm Credit West disclose certain or all of the following information to you about our collection and use of your Personal Information over the 12 months preceding any such request. Once we receive a verifiable Consumer Request, we will be able to disclose to you any of the following information if we have it:

    • - The categories of Personal Information we collected about you.
    • - The categories of sources for the Personal Information we collected about you.
    • - Our business or commercial purposes for collecting or, if applicable, selling that Personal Information.
    • - The categories of third parties to whom we disclosed that Personal Information for a business purpose or, if applicable, sold that Personal Information.
    • - The specific pieces of Personal Information we collected about you (also may be called a data portability request)
    • If we sold, or disclosed for a business purpose, your Personal Information, we will provide you with two lists disclosing (if applicable):
    1. - Sales, identifying the Personal Information categories that each category of third party received; and
    2. - Disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

    Deletion Request Rights
    You have the right to request that we delete all of your Personal Information that we collected from and about you, subject to certain statutory exceptions.  Once we receive a verifiable Consumer Request, we will identify the Personal Information, confirm that you want that Personal Information deleted if such request was submitted online, and then delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

    We may be unable to comply with, or may deny, your deletion request if retaining the Personal Information is necessary for us or our service provider(s) to:

      • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract(s) with you.
      • Use such Personal Information in the context of your role as a current or former employee or job applicant.
      • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
      • Debug products to identify and repair errors that impair existing intended functionality.
      • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
      • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code section 1546 et. seq.)
      • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
      • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
      • Comply with a legal obligation.
      • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

      • Opt-Out of Sale Rights
        California residents have the right to direct a business that sells (or may in the future sell) your Personal Information to stop selling your Personal Information and to refrain from doing so in the future.

    We do not and will not sell Personal Information as defined in the CCPA.

    Non-Discrimination
    We will not discriminate against you for exercising any of your legal rights regarding your Personal Information, unless permitted by law.  We will not take any of the following actions solely because you chose to exercise any of your legal rights regarding your Personal Information:

      • Deny you goods or services.
      • Charge you different prices or rates for goods or services, including through granting discounts or other benefits or imposing penalties.
      • Provide you a different level or qualify of goods or services.
      • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
    • Other California Privacy Rights

    California’s “Shine the Light” law (Civil Code section 1798.83) permits users of our website who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes.  To make such a request, use the contact information set forth below for general inquiries and requests.

    How to Submit a Consumer Request
    To exercise your access, data portability, and deletion rights, please submit a Consumer Request to the contact information below, unless you have an online account with us, commonly referred to as “myFCW”, in which case you may submit your request through your myFCW account. The Consumer Request must describe the request with sufficient detail that allows us to properly understand, evaluate and respond to it. Please specify if your Consumer Request pertains to all specific pieces of your Personal Information, or only with respect to the categories of Personal Information. You may only make a Consumer Request for access or data portability twice within a 12 month period. 

    How We Will Verify Consumer Requests
    Only you, or a person registered with the California Secretary of State that you authorize to act on your (or your minor child’s) behalf, may make a Consumer Request related to your (or your minor child’s) Personal Information.  To designate an authorized agent, we will ask you provide us with legal documentation (such as power of attorney documentation) or written permission and you will need to verify your own identity with us.

    We reserve the right to require you to provide additional information to enable us to reasonably verify that you are the person about whom the Personal Information pertains in order to release the requested information to you (or your authorized agent).  If you have an account with us, you will be asked to use the standard authentication procedures to access your account.  If you do not have an account with us, you will be asked to verify certain pieces of your Personal Information.  If we are unable to verify your identity, we may be unable to provide you with information responsive to the request.

    How We Will Respond to Consumer Requests
    We endeavor to respond to verifiable Consumer Requests within forty-five (45) days after receipt.  If we require more time (up to an additional 45 days) we will inform you of the reason and extension in writing.  If you have an account with us, we will deliver our written response(s) to that account.  If you do not have an account with us, we will deliver our written response(s) by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding receipt of the Consumer Request.  If we deny (or cannot comply with) the Consumer Request, we will explain why.  For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity.  We do not charge a fee to process or respond to your Consumer Request unless such request is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why and provide you with a cost estimate before completing your request.
